General Terms and Conditions
§ 1 Scope, definitions
(1) F&E Protective GmbH, Industriestraße 18, 94051 Hauzenberg, Germany (hereinafter: “we” or “Protective-Sports.com”) operates an online shop for goods on the website https://protective-sports.com. The following general terms and conditions apply to all services between us and our customers (hereinafter: “customer” or “you”) in the version valid at the time of the order, unless expressly agreed otherwise.
(2) A “consumer” within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An “entrepreneur” is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity, whereby a partnership with legal capacity is a partnership that has the capacity to acquire rights and to incur liabilities.
§ 2 Conclusion of contracts, storage of the contract text
(1) The following provisions on the conclusion of contracts apply to orders placed via our online shop at https://protective-sports.com.
(2) Our product presentations on the internet are non-binding and do not constitute a binding offer to conclude a contract.
(3) The following provisions apply upon receipt of an order in our online shop: The customer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop. The order is placed in the following steps:
- Selection of the desired goods,
- Adding the products by clicking the corresponding button (e.g. “Add to cart”, “Add to shopping bag” or similar),
- Checking the details in the cart,
- Calling up the order overview by clicking the corresponding button (e.g. “Proceed to checkout”, “Proceed to payment”, “Go to order overview” or similar),
- Entering/checking the address and contact details, selecting the payment method, confirming the general terms and conditions and the withdrawal policy,
- If the agreed characteristics of the goods deviate from their usual characteristics and conditions of use, confirmation of a negative agreement on characteristics,
- Completing the order by clicking the “Buy now” button. This constitutes your binding order.
- The contract is concluded when you receive an order confirmation from us at the email address you provided within three working days.
(4) If a contract is concluded, the contract is concluded with F&E Protective GmbH, Industriestraße 18, 94051 Hauzenberg, Germany.
(5) Before placing the order, the contract data can be printed out using the print function of the browser or saved electronically. The processing of the order and the transmission of all information required in connection with the conclusion of the contract, in particular the order data, the general terms and conditions and the withdrawal policy, take place by email after you have triggered the order, partly automatically. We do not store the contract text after the conclusion of the contract.
(6) Input errors can be corrected using the usual keyboard, mouse and browser functions (e.g. the browser’s »back button«). They can also be corrected by cancelling the ordering process prematurely, closing the browser window and repeating the process.
(7) The processing of the order and the transmission of all information required in connection with the conclusion of the contract take place by email, partly automatically. You must therefore ensure that the email address you have provided to us is correct, that receipt of the emails is technically ensured and, in particular, that it is not prevented by SPAM filters.
§ 3 Subject matter of the contract and essential characteristics of the products
(1) In our online shop, the subject matter of the contract is:
- The sale of goods and of gift vouchers (§ 10). The specific goods offered can be found on our product pages.
(2) The essential characteristics of the goods can be found in the product description. If the agreed characteristics of the goods deviate from their usual characteristics and conditions of use, this is expressly pointed out in the product description (negative agreement on characteristics). Insofar as the customer has given their express consent to the negative deviation in characteristics, this defines the subject matter of the contract.
§ 4 Prices, shipping costs and delivery
(1) The prices stated in the respective offers and the shipping costs are total prices and include all price components, including all applicable taxes.
(2) The respective purchase price must be paid before delivery of the product (payment in advance), unless we expressly offer purchase on account. The payment methods available to you are shown under a correspondingly labelled button in the online shop or in the respective offer. Unless otherwise stated for the individual payment methods, payment claims are due for payment immediately.
(3) In addition to the stated prices, shipping costs may be incurred for the delivery of products, unless the respective item is shown as free of shipping costs. The shipping costs are clearly communicated to you again in the offers, where applicable in the shopping cart system and in the order overview.
(4) Unless clearly stated otherwise in the product description, all products offered are ready for immediate dispatch (delivery time: two to three working days after receipt of payment). Gift vouchers are delivered by e-mail after receipt of payment, or on the chosen delivery date (§ 10(2)).
(5) The following restrictions on the delivery area apply: Delivery is made to the following countries: Andorra, Belgium, Bulgaria, Germany, Denmark, Estonia, Finland, France, Ireland, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Sweden, Switzerland, Spain, Czech Republic, Austria, United States of America. For deliveries to countries outside the European Union, additional customs duties, taxes and fees may apply. These are not included in our prices and are paid by you to the competent customs or tax authorities.
(6) If delivery of the goods fails for reasons for which you are responsible, you shall bear the reasonable costs incurred by us as a result. With regard to the costs of the outbound shipment, this does not apply if you effectively exercise your right of withdrawal. If you effectively exercise your right of withdrawal, the provision made by us in this regard in the withdrawal policy applies to the return shipping costs.
§ 5 Right of retention, retention of title
(1) You may only exercise a right of retention insofar as the claims arise from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 6 Right of withdrawal and voluntary right of return
(1) As a consumer, you have a right of withdrawal. This is governed by our withdrawal policy.
(2) In addition to the statutory right of withdrawal, we grant you a voluntary right of return for orders in our online shop of 30 days from the day on which you, or a third party named by you, received the goods. Within this period, you can return the goods to us without giving any reason. The period is met if you send the goods before it expires.
(3) The voluntary right of return requires that the goods are unworn and unused, complete and in a resaleable condition with all labels attached. Trying them on as you would in a shop is of course possible. We refund the purchase price via the payment method you used for the order. Gift vouchers are excluded from the voluntary right of return.
(4) Your statutory right of withdrawal and your statutory warranty rights remain unaffected by the voluntary right of return and are not limited by it.
§ 7 Contract language
German is the only contract language available.
§ 8 Liability
(1) Subject to the following exceptions, our liability for breaches of contractual obligations and for tort is limited to intent or gross negligence.
(2) In the event of slight negligence, we are liable without limitation in the case of injury to life, body or health or in the case of breach of an essential contractual obligation. If, through slight negligence, we are in default with performance, if performance has become impossible or if we have breached an essential contractual obligation, liability for property damage and financial loss attributable thereto is limited to the damage foreseeable and typical for the contract. An essential contractual obligation is one whose fulfilment makes the proper performance of the contract possible in the first place, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance you may regularly rely. This includes in particular our obligation to act and to perform the contractually owed service described in § 3.
§ 9 Statutory warranty
(1) The statutory warranty is governed by the statutory provisions.
(2) Towards entrepreneurs, the warranty period for delivered items is 12 months.
(3) As a consumer, you are asked to check the item/the digital goods or the service provided for completeness, obvious defects and transport damage immediately upon performance of the contract and to notify us and the forwarding agent of any complaints as quickly as possible. If you do not do so, this naturally has no effect on your statutory warranty claims.
§ 10 Gift vouchers
(1) You can buy gift vouchers (hereinafter: “vouchers”) in our online shop. The value of the voucher can be chosen freely between €20 and €1,000 or as a fixed amount from the values offered.
(2) Vouchers are delivered by e-mail only, either to you or to a recipient you name, on request on a date of your choice within one year. The e-mail contains the voucher code and a link to a printable version. Vouchers are not sent by post, and no shipping costs apply. You are responsible for ensuring that the recipient’s e-mail address you provide is correct.
(3) Vouchers can only be redeemed in the online shop at https://protective-sports.com. They cannot be redeemed on marketplaces on which we also sell, or at retailers. To redeem a voucher, enter the voucher code in the cart or at checkout.
(4) If the order value exceeds the balance, you can pay the difference with one of the payment methods offered. If the order value is lower than the balance, the remaining balance is kept and can be used for further orders.
(5) Vouchers and remaining balances are not paid out in cash and do not earn interest.
(6) Vouchers cannot be paid for with other vouchers. Discount and promotional codes do not apply to the purchase of vouchers. Not all payment methods are available for the purchase of vouchers; the payment methods offered are shown at checkout.
(7) Vouchers can be redeemed until the end of the third year following the year of purchase (example: purchased in 2026, redeemable until 31/12/2029).
(8) Vouchers are transferable. We may perform with discharging effect to the person who redeems the voucher code, unless we know, or do not know due to gross negligence, that this person is not entitled. Please treat the voucher code like cash. We accept no liability for loss, theft or misuse of a voucher code unless we are responsible for it.
(9) The statutory right of withdrawal under our withdrawal policy applies to the purchase of vouchers. If the purchase is withdrawn, we block the voucher. Amounts already redeemed are taken into account in the refund.
(10) If goods paid for in full or in part with a voucher are returned, or if such a contract is withdrawn, we credit the amount paid with the voucher back to the voucher. Any amount paid in addition is refunded via the payment method originally used.
§ 11 Final provisions/dispute resolution
(1) German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence (principle of the more favourable law).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) expressly do not apply.
(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the registered office of the provider.
